Terms of use — "CHEFS-D'ŒUVRE"

1. Acceptance of Terms

By downloading, accessing, or using the « CHEFS-D’ŒUVRE » mobile application (the « App »), published by Museum Lab in collaboration with the AMVPPC (Agence de Mise en Valeur du Patrimoine et de Promotion Culturelle), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the application.

2. Description of Service

The application provides an immersive Augmented Reality (AR) experience designed to be used within national museums in Tunisia. Features include QR code scanning to fetch 3D artifact models (.glb) and textual descriptions via our backend services.

3. Intellectual Property Rights

  • Artifacts and Content: All 3D models, images, textual descriptions, and cultural metadata displayed within the application are the exclusive intellectual property of the AMVPPC and the Tunisian State.

  • Software and Design: The application’s code, UI/UX design, and branding are the property of Museum Lab. You may not reverse-engineer, copy, or distribute any part of this application without explicit written consent.

4. User Conduct and Safety

  • Physical Safety: While using AR features, users must remain aware of their physical surroundings to avoid physical injury or damage to museum property.

  • Acceptable Use: You agree not to misuse the application, overload our servers, or attempt to gain unauthorized access to the application’s backend architecture.

5. Limitation of Liability

The application is provided on an « AS IS » and « AS AVAILABLE » basis. Museum Lab and AMVPPC shall not be held liable for any indirect, incidental, or consequential damages arising from your use of the app, including device damage, data loss, or physical injury occurring while using the AR features.

En téléchargeant, en accédant ou en utilisant l’application mobile « CHEFS-D’ŒUVRE », éditée par Museum Lab en collaboration avec l’AMVPPC (Agence de Mise en Valeur du Patrimoine et de Promotion Culturelle), vous acceptez d’être lié par les présentes Conditions d’Utilisation. Si vous n’acceptez pas ces conditions, veuillez ne pas utiliser l’application.

2. Description du Service

L’application offre une expérience immersive en Réalité Augmentée (AR) destinée à être utilisée dans les musées nationaux de Tunisie. Les fonctionnalités incluent le scan de codes QR pour afficher des modèles 3D d’artefacts (.glb) et des descriptions textuelles.

3. Propriété Intellectuelle

  • Artefacts et Contenu : Tous les modèles 3D, images, descriptions textuelles et métadonnées culturelles sont la propriété intellectuelle exclusive de l’AMVPPC et de l’État Tunisien.
  • Logiciel et Design : Le code de l’application, l’interface (UI/UX) et la marque sont la propriété de Museum Lab. Toute reproduction, distribution ou rétro-ingénierie est strictement interdite sans autorisation écrite.

4. Conduite de l’Utilisateur et Sécurité

  • Sécurité Physique : Lors de l’utilisation des fonctionnalités AR, vous devez rester conscient de votre environnement physique pour éviter toute blessure ou dommage aux biens du musée.
  • Utilisation Acceptable : Vous acceptez de ne pas utiliser l’application de manière abusive, de ne pas surcharger nos serveurs et de ne pas tenter d’accéder sans autorisation à l’infrastructure technique de l’application.

5. Limitation de Responsabilité

L’application est fournie « TELLE QUELLE » et « SELON DISPONIBILITÉ ». Museum Lab et l’AMVPPC ne sauraient être tenus responsables de tout dommage indirect, accidentel ou consécutif découlant de l’utilisation de l’application, y compris les dommages à l’appareil ou les blessures physiques survenues lors de l’utilisation de l’AR.

6. Droit Applicable et Contact

من خلال تنزيل أو الوصول إلى أو استخدام تطبيق الهاتف الجوال « CHEFS-D’ŒUVRE »، الذي نشرته Museum Lab بالتعاون مع وكالة إحياء التراث والتنمية الثقافية (AMVPPC)، فإنك توافق على الالتزام بشروط الاستخدام هذه. إذا كنت لا توافق على هذه الشروط، يرجى عدم استخدام التطبيق.
 
2. وصف الخدمة
يوفر التطبيق تجربة غامرة في الواقع المعزز (AR) مصممة للاستخدام داخل المتاحف الوطنية في تونس. تشمل الميزات مسح رموز الاستجابة السريعة (QR) لجلب نماذج ثلاثية الأبعاد للتحف الفنية والأوصاف النصية.

3. الملكية الفكرية
التحف والمحتوى: جميع النماذج ثلاثية الأبعاد والصور والأوصاف النصية المعروضة داخل التطبيق هي ملكية فكرية حصرية لوكالة AMVPPC والدولة التونسية.

البرمجيات والتصميم: رمز التطبيق وتصميم واجهة المستخدم هما ملك لـ Museum Lab. يُحظر تمامًا نسخ التطبيق أو توزيعه أو إجراء هندسة عكسية له دون إذن كتابي صريح.
4. سلوك المستخدم والسلامة
السلامة البدنية: أثناء استخدام ميزات الواقع المعزز، يجب أن تظل على دراية بمحيطك المادي لتجنب الإصابة البدنية أو إلحاق الضرر بممتلكات المتحف.
الاستخدام المقبول: توافق على عدم إساءة استخدام التطبيق، أو إرهاق خوادمنا، أو محاولة الوصول غير المصرح به إلى البنية التحتية الفنية للتطبيق.
5. تحديد المسؤولية
يتم توفير التطبيق « كما هو » و « كما هو متاح ». لا تتحمل Museum Lab و AMVPPC أي مسؤولية عن أي أضرار غير مباشرة أو عرضية ناشئة عن استخدام التطبيق، بما في ذلك تلف الجهاز أو فقدان البيانات أو الإصابات البدنية التي تحدث أثناء استخدام ميزات الواقع المعزز.
